Federal Covered Advisers

Federal Covered Advisers required to file notice and investment adviser representatives required to be registered shall make their West Virginia notice and registration filings, including renewals, amendments and statutory filing fees, through the "IARD" www.IARD.com Phone: 240.386.4848.

Notice Filing Procedures for "Federally Covered" Adviser (SEND NO DOCUMENTS TO THIS OFFICE).

To file in the State of West Virginia, the following information is required:

Form ADV on "IARD"
$200.00 fee paid through the "IARD"

Additionally, if you have a "place of business" in West Virginia:

Form U-4
$100.00 fee ($85.00 renewal) for each representative paid through the "IARD"
Proof of exams: a Series 65 or a Series 7 and a Series 66. Grandfathering: a Series 63 and one (1) other NASD exam, if they were passed before January 1, 1995, or just a Series 66 if it was passed before January 1, 2000. Waivers: for professional designations CFP, ChFC, PFS, CFA, & CIC. No waiver will be considered except upon written request.

All Notice Filings and Representative Registrations expire December 31st of each year.

NOTE: If a new adviser has a "reasonable expectation" that they would be eligible for federal registration within 90 days, they should submit a notice filing in West Virginia. Also, Advisers may claim the de minimis exemption from the notice filing requirement if they have no place of business in this state and, during any period of twelve (12) consecutive months, the Adviser does not have more than five (5) clients who are residents of this state.
